Welcome to MatchaName. These terms govern your use of the MatchaName mobile application (the "Service"). By using the Service, you agree to these terms.

MatchaName is an application that helps expectant parents choose a name for their child. Depending on the features available, you can in particular:
The Service may evolve, and some features may be added, modified or removed.
To use the Service, you must create an account via Sign in with Apple. You must be at least 16 years old to create an account (article 8 of the GDPR as applicable in France). You are responsible for the confidentiality of the information associated with your Apple account.
In addition to its free features, the Service may offer paid features accessible via in-app purchases (one-off purchase and/or auto-renewing subscription, depending on the offer presented at the time of purchase).
Purchases are processed exclusively by Apple through the App Store, in accordance with the Apple Media Services Terms. The applicable price, currency, subscription duration (if any) and renewal terms are shown to you by Apple before you confirm the purchase. Managing your purchase (review, turning off auto-renewal, cancellation, refund request) is done from your Apple account settings or by contacting Apple Support.
Where applicable, you expressly acknowledge and agree that performance of the digital service begins immediately upon purchase, and you accordingly waive your statutory withdrawal right with respect to digital content supplied immediately (in France, article L221-28 13° of the Consumer Code).
MatchaName is not involved in payment processing and does not store any payment card data. For billing issues, contact Apple directly; for any other question about a paid feature, email us at support@matchaname.com.

Failure to comply with these rules may result in the suspension or deletion of your account without notice.
The Service, its design, its code, its database of names and all of its contents are the property of Arilem Studio or are licensed to Arilem Studio. No use or reproduction is permitted without prior written consent.
The content you provide (your display name, your family name, your profile picture) remains your property. You grant Arilem Studio a limited, non-exclusive and free licence to store and display this content solely for the purpose of operating the Service.
The processing of your data is described in the Privacy Policy, which forms an integral part of these terms.
You can delete your account at any time from the You → Account → Delete my account screen. A 30-day grace period applies: you can cancel the deletion by signing back in during this period. After that, deletion is permanent and irreversible. Account deletion does not entitle you to a refund of purchases already made, which remain governed by Apple's terms. See the Privacy Policy for retention details.
The Service is provided "as is", with no warranty of continuous availability or freedom from errors. Arilem Studio endeavours to keep the Service operational but cannot guarantee uninterrupted operation, including in the event of maintenance, an outage of a third-party provider (Apple, Supabase) or force majeure.
To the extent permitted by law, Arilem Studio shall not be liable for indirect damages resulting from the use of, or inability to use, the Service. The choice of a name for your child is your sole responsibility; MatchaName is only a decision-support tool.
These terms do not affect the rights that the law grants to consumers, in particular the statutory warranties of conformity and against hidden defects.
Arilem Studio may update the Service and these terms over time. In the event of a substantial change, you will be informed via the application or by email. Continued use of the Service after notification constitutes acceptance of the new terms.
In the event of a dispute, we invite you to contact us first at support@matchaname.com in order to seek an amicable solution.
If you reside in the European Union, you may also use the European online dispute resolution platform.
These terms are governed by French law. In the event of a dispute, and after an attempt at amicable resolution, the French courts shall have exclusive jurisdiction, subject to mandatory provisions applicable to consumers.
